Long Service Leave
The rules for self-employed contractors being able to participate in portable long service leave schemes varies throughout Australia. For example, in Western Australia, contractors cannot participate in the scheme, in Queensland, labour only or substantially labour only contractors are treated as employees, yet in Victoria, “working subcontractors” must register but they do not have to make financial contributions if they don’t want to.

Those contractors who operate as a sole trader or as a partner in a partnership in Queensland are often not aware that they can join the portable long service leave scheme for the building and construction industry. Similarly, in Queensland, those who engage contractors who are eligible to join the scheme, are often unaware that they will be regarded as their "employers" for portable long service leave purposes.
