A "subcontract worker" is a worker who performs work other than as an employee. A "worker" is someone who performs building and construction work (as defined in the Act).

You need to call the Corporation & get the forms sent to you.

            Ongoing reporting

Claim for Service Credits”, you will need to include information such as:

  • the amount of assessable income earned by you in performing work in the building & construction industry (i.e. the amount you put in your personal income tax return that relates to this type of work);
  • the tax deductions you claim in relation to this income
  • details of any work performed in the building and construction industry outside NSW

            Record of Credits

As soon as possible after 31 July of each year, the corporation will send you the details that they have on their register as at 30 June of that year.

The number of days "service" you will be credited with will depend upon the amount of income you have claimed in your return.

            Records to be Kept By You

You will need to keep those books and records that contain copies of:

  • Any “Claims for Service Credits”; and
  • Accounting, tax and other records relating to any claim or proposed claim.

The levy is .35% of the cost of erecting the building (where the cost is ≥ $25,000)

            Who Pays?

Ultimately, it is the owner who bears the cost of the levy, however, the person who pays it in the first instance is:

  • If a construction certificate is required or a complying development certificate is issued – the person to whom the certificate is issued
  • If a construction certificate is not required & a development consent is granted – the person to whom the consent is granted
  • In any other circumstances – the person for whom the building is being erected (i.e. the owner)
