Application of ‘Fit and Proper’ test for Building Practitioner renewals - WA

The WA Department of Mines, Industry and Regulations (DMIRS) has published a notification regarding a change in approach to be taken from 1 September 2020 for all building practitioner renewals in relation to the ‘fit and proper’ test.

The Building Services Board (BSB) is required to be satisfied that every Building Practitioner, Building Services Practitioner and Painting Practitioner applying for registration or renewal is a ‘fit and proper person’. This is an existing legislative requirement of the Building Services (Registration) Act 2011 (BSRA).

The BSB has a policy that outlines how the fitness and propriety of a building services practitioner is assessed, being “Fit and proper person assessment criteria for the issue of registrations policy”.

What has changed?

From 1 September 2020, the BSB will require that a National Criminal History Check (NCHC) accompany all applications for all Practitioner registrations and renewals. This NCHC must not be older than three months at the time of application, unless a practitioner has previously supplied DMIRS with an NCHC within the last 12 months (for example, if a practitioner holds multiple registrations that fall due for renewal inside a 12 month period).

How does this affect me?

The renewal period for all affected practitioners remains at the current three year cycle.

To date, the BSB have not typically requested an NCHC for renewal applications. All registrations, changes, updates and now renewals for practitioners defined within the BSRA will be required to submit an NCHC less than three months old. 

You can find a list of accepted NCHC providers on the DMIRS website, and both a National Police History Check (NPHC) and National Police Certificate (NPC) are valid evidence for an NCHC.

Please be advised that an NCHC, NPHC or NPC can take up to fifteen business days to approve and issue, on top of time needed to prepare the information required for the application and postage.
