Updates

• TAS Residential Building Contract
has updated clauses 44 to 46 in relation to dispute resolution including: parties seeking to resolve a dispute themselves under Clause 44, the mediation process under Clause 45, and options to proceed to TASCAT under Clause 46.

SA Building Contract for New HomesUpdates include an "all weather access" definition and only the Progress Payment schedule selected included in the contract. Will apply to new contracts and contracts In Progress from 11 June 2025.


• WA General Housing Specification - Form 7
Updates have been made to the WA General Housing Specification – Form 7 to be used with the NCC 2022 Amendment 1, Volume Two. All specifications in progress will automatically reflect the updates made.


• WA Cost Plus Contract
has been updated to Form 13E. The updates include simplified language, shorter clauses and additional headings and clause numbering. The following clauses have been updated: Clause 1 Agreement to Build, Clause 2 Owners Warranties, Clause 3 Possession of the Site and All Weather Access, Clause 5 Builders Duties, Clause 6 Costs, Clause 8 Insurance, Clause 9 Variations, Clause 19 Notices, Clause 20 Computation of Time has been deleted, Clause 21 Severance and a new Clause 23 Interpretation. We strongly recommend that you read the "Form 13D to Form 13E: What you need to know about the changes" information sheet available on the HIA website.
