Australian standard contracts

HIA workplace advisers are sometimes contacted by members who have been told by client that their bank wants an Australian Standard contract, such as the AS4000-1997 and AS2124-1992, to be used by the builder for a residential building project. These contracts require modification before they will comply with the Residential Building Work Contracts and Dispute Resolution Act 2016. It is also not generally feasible to use an Australian Standard contract without special conditions, as these standards are now relatively old documents.

Therefore, if a member is going to use an Australian Standard contract they should engage a lawyer to help them prepare the contract to ensure that they comply with all legal requirements and properly manage the risk of the project.
