Bushfire exemption provisions extended

April 14, 2019

The Building Regulations have been updated to extend the exemptions from the BCA bush fire construction requirements for certain alterations and extensions in designated bush fire prone areas. The exemption has been extended for a further two years, until 1 May 2021.

This exemption prevents minor alterations and additions from requiring bushfire prone construction where:

  • the estimated value of the building work is less than $20,000; or
  • there is no increase the risk of ignition from bushfire attack for the existing building.

The option for making an application to the Building Commissioner for a declaration to modify or not apply a bush fire building standard has also been extended for a further two years, until 1 May 2021.

HIA successfully advocated to have this exemption extended to allow industry to understand the provisions contained in the 2019 NCC and 2018 version of AS3959 Construction in Bushfire Prone dwellings.
