Industry Bulletin 111 – Dealing with errors in a certified building permit application

Building and Energy have produced Industry Bulletin 111 to clarify how errors detected in certified building permit applications should be handled. 

The Bulletin confirms that the Building Act 2011 does not create a duty for a permit authority to check the accuracy of a fact or the soundness of an opinion asserted in a Certificate of Design Compliance (CDC). However where the permit authority forms a genuine view that there is an error in the CDC or associated documents in the normal course of considering the assessment as required, the permit authority used has the power to refuse to grant the building permit.
