Guide to using the HIA Design Only Contract

HIA offers a Design Only Contract to be used by designers who perform design services, but don’t perform any residential or domestic building work.

A Design Only Contract should be used by designers who offer design services, but don’t perform any residential or domestic building work. This can include designs for kitchen, laundry and bathroom areas.

HIA offers a Design Only Contract that designers can use when they are to be engaged on a project. This resource explains some of the key provisions of the HIA Design Only Contract.

Included in this resource are sections on how much should be charged as a deposit, what payment terms can be used, and whether the design fee can be varied. Warranties are set out under Australian Consumer Laws. This means that services must be provided with due care and skill, be fit for their specified purpose and provided within a reasonable timeframe. 

Designers retain all copyright and other intellectual property rights in their work. But if the client provides any material or content, they will retain ownership of the intellectual property rights. Designers should also ensure they have appropriate insurances before they sign a Design Only Contract.
