With so much uncertainty and concern surrounding the Government’s latest tax changes, what do they actually mean for you and your building business?

Changes to the taxation of discretionary trusts, impacting on unit trusts, and termination of the 50% discount applicable to certain capital gains have significant implications for many in the building industry including builders, trades, property owners, intending investors, succession arrangements and beyond and wealth protection.

Join DW Fox Tucker Lawyers for a practical webinar designed to help HIA members understand the changes and navigate their disruption.

What we’ll cover

  • The changes – A selective overview of the tax reforms as legislated and introduced. 
  • 30% Minimum Tax for discretionary trusts – Its application to the net income of discretionary trusts, including most private unit trusts, and to realised capital gains accruing from 1 July 2027.
  • Loss of the 50% discount on trust and individual capital gains - How this works, its replacement by and integration with indexation.
  • Alternative structures – Individual partnerships and personal services income considerations, companies and fixed trusts.
  • Rollovers – Those available for the restructure of ‘minimum tax trusts’ and those existing.
  • State taxes – Stamp duty on interests in other than ‘qualifying land’ and registration fees.
  • Private company operation – Some things to watch out for if rolled into.
  • Small business CGT concessions – Briefly, in the context of the CGT changes.
  • Testamentary trusts – The preservation of their discretionary trusts where for ‘genuine’ reasons.

This webinar will help you understand the broad impact of the proposed changes and is planned to help members identify the issues actually or potentially affecting them and the time frame they have in which to address them if they feel the need to do so.
