HIA’s Human Resources (HR) agreements are formal workplace documents that can be used by all employers throughout Australia.

Who can use the HR agreements?

All of HIA’s HR agreements, except for the Deed of Release, are based on federal industrial relations laws. That means they can be used by all employers throughout Australia, except for:

  • non-constitutional corporation employers in Western Australia 
  • state public sector employees (i.e. employees of a Minister, the Governor or the Crown) except in Victoria 
  • local government employers — except in Tasmania and Victoria. 

If your business is operated under a sole trader or partnership structure in Western Australia, please contact your workplace adviser to discuss the application of this document to your workplace.

The Deed of Release can be used by all employers, regardless of where they are situated or which business structure they use.

 

Which HR agreements do I need?

Building Industry Award Specific Letter of Engagement

This document is suitable for full-time, part-time or casual employees whose main terms and conditions of employment will be provided in accordance with those building industry awards most commonly used by HIA members. The letter is intended to outline some significant conditions including Hours of Work and the RDO system, and provides clarification in relation to those allowances that are included in the hourly rate.
Please note – variation of these award conditions is only possible where both parties genuinely agree to enter into an Individual Flexibility Agreement (‘IFA’) to suit their particular circumstances. IFA’s can only be entered into after a person has started as an employee with the employer.

This contract of employment, which is for a specified period of time, will typically end without either party needing to give notice to terminate since the contract will conclude through the passage of time, not at the initiative of either the employer or employee.
This contract is suitable for full-time and part-time employees. It is not suitable for casual employees or independent contractors.

This contract of employment, which is for a specified period of time, will typically end without either party needing to give notice to terminate since the contract will conclude through the passage of time, not at the initiative of either the employer or employee.
Alternatively, the contract may be terminated by the giving of notice to terminate in accordance with the terms of the contract.
This contract is suitable for full-time and part-time employees.

Deed of Release

This deed is general in nature. It contains some standard clauses which are usually included in a deed, but does not contain a comprehensive array of provisions to deal with every eventuality. It can be used for an existing employee who is in the process of leaving the organisation, or an employee whose employment has already been terminated. Legal advice should be obtained in the event that this Deed of Release needs amending.

This letter is a simpler form of the Contract of Employment document. If you want a more comprehensive contract of employment for your employees, you should use the Contract of Employment, rather than this document.

This document is suitable for full-time, part-time or casual employees whose main terms and conditions of employment will be provided in accordance with an applicable award, or enterprise agreement. The letter is intended to outline some significant conditions from the award or agreement and additional terms and conditions of employment.

Individual Flexibility Agreement (Award covered) - new

Flexibility provisions within Modern Awards allow employers and an individual employee to enter into an arrangement (known as an Individual Flexibility Agreement) whereby certain terms of the Award are modified to meet the individual circumstances of the employment relationship.

An Individual Flexibility Agreement (‘IFA’) can only be entered into if it results in the employee’s terms and conditions of employment being better off overall (compared with if they hadn’t entered into the IFA).

Because an IFA can only be entered into if it results in the employee’s terms and conditions of employment being better off overall (compared with if they hadn’t entered into the IFA), it is advisable for employers who have already entered into an IFA with employees to regularly review them to ensure that it still meets the ‘Better Off Overall Test’.

HIA’s workplace advisers can help members review their IFA’s especially as they necessarily involve the performance of sometimes complicated calculations.

Offer of Guarantee of Annual Earnings

When modern awards came into effect on1 January 2010, many previously award-free employees were potentially caught by the wide coverage of the new industry-based awards. However, for a ‘high- income’ employee, the employer and the employee can enter into an agreement known as a 'Guarantee of Annual Earnings'.

The guarantee represents a commitment by the employer to pay the employee no less than an amount that exceeds a ‘high-income threshold’ during a ‘Guarantee Period’ and in exchange for that guarantee, the relevant modern award that covers the employee ceases to apply.
