When will the updated Victorian HIA domestic building contracts be available?

Members are encouraged to use the HIA’s Contracts Online system for the purchase of any new Victorian domestic building contracts. Using Contracts Online will ensure that you are using the latest version.

When do I have to pay the FRHWS Insurance premium?

You must pay the insurance premium to the Building and Plumbing Commission (BPC) before the first of the following occurs:

(a) 10 business days elapse after the day on which the contract is signed; or  

(b) the building works start.

FRHWS is available now from the BPC portal.

What if my building works are below $20,000?

Builders are not required to purchase the FRHWS if the building works are below $20,000. However, the builder is required to pay the FRWHS premium if a variation increases the total value of the building works to $20,000 or above, in which case, the builder will have 10 business days after the variation has been signed to pay the premium. Otherwise, the builder may face a penalty of $102,000 for an individual, or $509,000 for a corporation.
Which contracts do I use?

For contracts signed from 1 July 2026 you will need to use the new suite of HIA Victorian domestic building contracts.
Can I continue to use my existing versions of the HIA contracts from 1 July?

No. Members should not use any hard-copy HIA contracts printed before 1 July 2026 and should return any unused hard copy contracts to us to receive COL credits. The reason for this is that changes that commence 1 July 2026 must be incorporated in all Victorian domestic building contracts signed from that date.

HIA does not recommend using special conditions to amend existing contracts. However, if required, please contact our Contracts and Compliance team for assistance. Our preference is for you to return any existing hard copies for credits.

What do I do with my existing HIA contracts?

HIA recommends that you return your existing HIA contracts to us. We will provide a credit for those contracts that are returned to us.
If I sent a contract prior to 1 July but the client returns it after 30 June which insurance do I need to purchase and when?

Any contract received by the builder on Wednesday 1 July 2026 or later (even if it is the prior version of the HIA contract) will be subject to the new laws and the builder must purchase FRHWS and pay the premium within 10 business days.
What if the client signs the contract but does not pay the deposit? Do I still have to pay the insurance premium under the FRHWS?

For contracts signed on or after 1 July, the requirement to pay the insurance premium is no longer linked to payment of the deposit, rather it starts as soon as the contract has been signed.

For this reason, HIA advises members not to send clients signed contracts until the client is in a position to pay the deposit. HIA has also amended our contracts to require clients pay the deposit with 5 business days of signing to ensure the member has the resources to pay the FRHWS premium.

For contracts signed prior to 1 July 2026 where no deposit has been paid before that date see below.

What if contracts are signed prior to 1 July 2026, but no deposit is paid? Are they subject to the DBI or the FRHWS and when do I need to pay the premium?

HIA has been advised by the Department of Transport and Planning that DBI policies will continue to be available for purchase from the BPC for domestic building contracts entered into before 1 July 2026.

HIA advisers members to seek advice from a legal professional to determine if the contract would be considered “entered into” in these circumstances and whether DBI or FRHWS is required.

HIA advises members not to send clients signed contracts until the client is in a position to pay the deposit. The reason for this is that once the contract is signed FRHWS insurance premium must be purchased by the builder within 10 business days.  HIA has also amended our contracts to require clients pay the deposit with 5 business days of signing to ensure the member has the funds to pay the FRHWS premium.

Can I get a client to commit to a project without signing a domestic building contract?

The builder has 10 days to pay the premium as soon as the contract has been entered into, even if the build date has not yet been finalised.

HIA recommends builders consult with a legal professional if the builder wishes to use a preliminary agreement or some other form of preconstruction agreement to secure a client. This is because builders may face significant penalties.

Do I need to pay an additional insurance premium if there is a variation?

Yes. The builder will need to pay an additional premium to the BPC or on the BPC portal for variations that cost $5,000 or more. The additional premium is to be paid within 10 business days after the variation has been signed and agreed to.

What is Optional Additional Insurance?

The FRHWS allows homeowners to purchase additional insurance cover for claims exceeding the $400,000 FRHWS threshold. This insurance is called Optional Additional Insurance and attracts an additional cost. Either the builder or the homeowner may apply for this additional cover and must pay the additional premium to the BPC within 10 business days of signing the contract (or when the building work starts if this is an earlier date). 
Will the HIA contract be changing again later this year?

Yes. Amendments to the Domestic Building Contracts Act 1995 are expected to take effect on 1 December 2026. These amendments will require significant changes to HIA’s standard domestic building contracts, however we are still waiting for the regulations before we can finalise those contracts.
