When times are tough it can be easy to lose sight some of the longer term prospects for your business. It is important to remember the excellent homes, and happy clients, that are the direct result of your hard work. One of the best ways to promote your business, celebrate the great work you’ve done and recognise the contributions of your team is to participate in the HIA Awards. Entries have now opened and we encourage all our members to participate.
This year has started with a few home building company insolvencies. Unfortunately there will be more as the year progresses, and as happened last year, there is a lot of speculation about builder solvency. It is worth remembering that last year most of the speculation turned out to be wrong and this year should be no different. Regrettably much of this speculation can be found on social media, and as many members know from personal experience with “customer” and similar reviews, this is not always reliable or honest information. While there are definitely many home building businesses having a difficult time, only some of these are considering or heading into insolvency. Most of our members will work through the current challenges and continue to trade successfully.
Members are also reminded that laws are expected to soon be introduced to make it an offence to accept a deposit for a home building contract without first getting a domestic building insurance policy for that job. However, it is already a requirement that this insurance be obtained before a deposit is paid. The offence will complement that existing requirement and also complements the VBA’s existing power to impose license sanctions. A recent insolvency has highlighted that a minority of builders are still accepting deposits without first getting the domestic building insurance policy. It is expected that there will be further enforcement action by the VBA and other regulators in coming weeks.
Finally, late last year we advised members that the Victorian government was reviewing the Domestic Building Contracts Act. HIA is preparing a submission and has a number of points to make based on member experiences and feedback over many years. HIA has already received many comments and suggestions from members about the appropriate response to the Domestic Building Contracts Act review and we welcome more feedback.

HIA released a member alert on Tuesday to inform members that the Victorian government had introduced a Bill into Parliament to establish new consumer protection measures.
