The finalists of the People’s Choice Home Award will be selected from all shortlisted finalists in Housing Category projects that are individual whole home dwellings across HIA’s Housing Awards program. The winner will be determined entirely by public vote.

General Terms and Conditions

Conditions of entry

1. Information on how to enter and prize details set out in the Schedule form part of these general terms and conditions (T&Cs).
2. By participating in the Promotion, Participants agree to be bound by the T&Cs.

Entry rules and requirements

3. The Promotion will be conducted during the Promotion Period.
4. Entry is open only to all Participants aged 18 years or older who satisfy the Who Can Participate section detailed in the Schedule.
5. Directors, officers, management, employees, suppliers (including Prize suppliers) and contractors (and the immediate families of directors, officers, management, employees, suppliers and contractors) of the Promoter are ineligible to vote.
6. The Participant must follow the Method of Entry during the Promotion Period to enter the Promotion. Failure to do so will result in an invalid entry. The Promoter will not advise a Participant if their entry is deemed invalid.
7. The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise, including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. No correspondence will be entered into.
8. Entrants may submit up to the maximum number of entries specified in the Schedule (if applicable).

The Prize

9. The Promoter offers no individual prize or reward to participants voting or participating in the Promotion.
10. There is no cash prize to the winner. The winner will receive a certificate and/or plaque.

Winner selection

11. The Prize will be awarded in accordance with the Judging Details section of the Schedule. The Promoter’s decision is final and no correspondence will be entered into.
12. The winner(s) of the Prize will be notified in accordance with the Details of Prize and Notification of Winners sections of the Schedule.
13. Notification to winners will be deemed to have occurred on the later of the time the winner receives actual notification from the Promoter or two Business Days after notification is given by the Promoter in accordance with the Schedule.
14. The notification will include details about how the prize(s) can be claimed. In this clause, Business Day means any day except for Saturday, Sunday or a public holiday in the Australian Capital Territory, Australia.
15. The Promoter takes no responsibility where it is unable to contact winners who have not provided correct or complete contact details or who otherwise have not received the actual notification for any reason. If an Entrant’s contact details change during or after the Promotional Period, it is the Entrant's responsibility to notify the Promoter. A request to modify any entry information should be directed to the Promoter.
16. There will be no unclaimed prize draw.

Warranties and exclusion of liabilities

17. Nothing in these T&Cs limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all warranties and all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion.

Errors, omissions and exclusions

18. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Termination of Promotion and exclusion of entries

19. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.

Privacy and Collection Notice

20. The Promoter will use and handle personal information ("PI") collected from participants in accordance with its Privacy Policy, which can be viewed at https://hia.com.au/privacy. The Privacy Policy also contains information about how participants may opt out, access, update or correct their PI, how participants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose participants' personal information to any entity outside Australia.
21. Notwithstanding any other terms and conditions, participants consent to the Promoter using the personal information provided in connection with this competition for the purposes of conducting the Promotion (which may include disclosure to third parties for the purpose of processing and conducting the Promotion) and for promotional purposes, public statements and advertisements in relation to the Promotion, and providing information to participants about the products and services offered by the Promoter and its related companies.

23. This Promotion is in no way sponsored, endorsed or administered by, or associated with, PollUnit. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to PollUnit.
24. By participating in the Promotion, the participant agrees to hold harmless, defend and indemnify PollUnit from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to the participant’s participation in the Promotion (including taking or use of a Prize). PollUnit will not be liable for any loss or damage or personal injury which is suffered or sustained by a participant as a result of participating in the Promotion (including taking or use of a Prize), except for any liability which cannot be excluded by law.

25. Facebook, YouTube or Instagram may be used to advertise or promote the Promotion. By entering the Promotion, Participants agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, YouTube or Instagram, and release Facebook, YouTube and Instagram from all liability in relation to this Promotion. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and not to Facebook, YouTube or Instagram.
