HIA Insurance’s Legal Expenses Insurance provides you with legal advice and will cover your costs in the event of a contractual dispute (conditions apply).

It’s an unfortunate reality that one small mistake, injury or perceived piece of bad advice can lead to a claim against your business, or you having to make a claim against a supplier or client – and potentially cost you both professionally and financially.

How can Legal Expenses Insurance help you?

With you and your business’ interest in mind, we have developed Legal Expenses Insurance for builders, tradies and subcontractors. This cover gives you access to legal advice, covers your costs and attendance expenses, and your opponent’s costs incurred from an industry-specific contractual dispute with a customer or supplier with an excess of just $1000 per claim.*

Legal Expenses Insurance: What you’re covered for

As well as giving you access to a dedicated legal team that can advise you on matters relevant to your business, its operations and handling claims, Construction Legal Expenses Insurance covers you for the following costs*:

Before proceedings – legal fees and expenses incurred in relation to legal disputes, regulatory inquiries, etc.

During/after proceedings – legal fees and expenses and attendance costs incurred in either pursuing or defending your business in ongoing litigation.

Unsatisfactory subcontractor job

After the Insured had hired a company to clean the exterior of the office building, some ‘white specks’ appeared on the brickwork that appeared to be salt stains. The Insured called the Telephone Legal Advisory Service to ask how to proceed. The lawyer provided direction to the Insured on how to negotiate with the cleaning company to rectify the damage, including withholding the balance of the invoice until the Insured was satisfied.

Faulty goods from a supplier

The Insured took delivery of goods from a supplier, but the goods were faulty. The Insured refused to pay the invoice and was taken to court by the supplier. The policy covered the cost of legal representation to defend the action.

Payment dispute with homeowner

The Insured was owed a substantial final progress claim by a home owner, who was refusing to pay on the basis that some of the works were defective. The insured lodged a claim against the policy and the cost of legal representation to pursue the outstanding progress claim through the courts was covered.
