Commencement of NCC 2022 in the ACT

Following an extended phase in period, the livable housing, energy efficiency and condensation provisions of NCC 2022 will commence in the ACT on 15 January 2024.

In September 2023, the ACT Government announced an extended phase in period for the livable housing, energy efficiency and condensation provisions of the National Construction Code (NCC) 2022. From 15 January 2024, this phase in period will end and these requirements will apply to new building approvals. 

What parts of NCC 2022 commence on 15 January 2024?

The following provisions of NCC 2022 will commence on 15 January 2024:

  • Residential 7-star energy efficiency and whole-of-home requirements for new houses and apartments
  • Requirements relating to future provision of electric vehicle charging infrastructure, solar photovoltaic panels and battery systems in Class 2 – 9 buildings
  • Condensation mitigation
  • Livable housing.

These changes are in addition to changes to NCC 2022 that commenced on 1 May 2023.

What projects do the provisions apply to?

Building approvals determined on or after 15 January 2024 must comply with:

  • NCC 2022 and any variations contained in the ACT Appendix, regulations or other instruments issued under the ACT’s building regulatory system.

These requirements also apply to any building work that does not require approval but is commenced on or after 15 January 2024.

What has changed in the ACT Appendix?

The ACT Appendix to the Building Code of Australia – Volumes 1 and 2 contains new or amended variations to the NCC that will also apply from 15 January 2024.  These variations primarily address the application of the: 

  • Energy efficiency requirements of Part H6 of NCC Volume Two to alterations to existing buildings and,
  • Livable housing design requirements of Part H8 of NCC Volume Two to alterations to existing buildings
