Workers in the building and construction industry can receive long service payments based on their service to the industry, rather than their service with a single employer.
If you employ workers who work onsite and in some offsite settings like joinery workshops, you are required to notify the Long Service Corporation (Corporation) when an employee commences and ceases employment with you. Employers are required to complete a report to the Corporation each July called a “Employer Return".
Employers must complete the Employer Return (which is a list of all employees), confirm and update their workers’ service to the Corporation by 31 July each year.
The Employer Return can be completed online via the Employer online portal.
The Corporation publishes user guides to assist employers manage portable long service for their workers through the Employer online portal.
If you don’t complete the Employer Return by the due date, you will receive a Statement of Obligation notice, providing a further opportunity to complete the Return.
If there is no Employer Return completed by the end of August, the Corporation will issue a Notice of Inspection to conduct an audit of the business records to verify worker service.
Failure to complete the Employer Return on time carries a maximum penalty of $2,200.
If you employ eligible workers, it is important that you notify the Corporation when a worker starts with you, and when their employment ends. To do this, employers are required to complete a Start Notice within 7 days of an employee commencing work with you.
Self-employed workers are also eligible to register with the scheme to receive long service benefits.
