If ever you engage a tradesperson or other contractor to work on a project, you’ll need to understand the legal requirements associated with hiring that worker.
By ensuring you meet your legal obligations you can minimise the risk of contravening the law or facing an unexpected employment claim.
This resource contains a checklist you can use when reviewing your trade agreements. It can be used to clarify the relationship that exists between you and your contractors and delineate what role both parties are expected to perform.
Included in the checklist are requirements that a contract be entered into that contains detailed information on each contracting party. A general description of the scope of works should also be given. The contractor also needs to provide copies of their own insurances and ensure that they will provide their own tools and equipment. Consult the resource to find out what other items are on the checklist.
Note that the checklist is a guide only and the HIA recommends all contracting parties establish if the proposed contract terms are suitable for their individual circumstances.
