TasBuild - request for information from employers

October 09, 2019

The HIA has become aware of TasBuild showing greater interest in requesting information from employers or possible employers in relation to the status of their workers.

TasBuild is responsible for the administration of the Construction Industry Long Service Scheme established by the Construction Industry (Long Service) Act 1997 (“the Act”).

The Construction Industry Long Service Scheme is a type of portable long service leave for workers in the construction industry who are engaged as employees.

TasBuild is given some power under the Act to require the production of information from an employer or possible employer such as records of employment for an employee. Requests for information by TasBuild should be made in writing providing builders with the opportunity to review the request and seek legal advice about how to respond.

If a TasBuild representative attends your site or office to request information from you, you are entitled to refuse the request and politely ask the representative to leave. Members should not feel the need to provide the information if the request is made in this way. A written request for information and a written response after receiving advice is the better way.

The HIA has developed information sheets to assist members with understanding the role and enforcement powers of TasBuild and employer obligations under the Scheme.

These information sheets are available on the HIA website.
