Access HIA Terms of service

Access HIA Terms of service

Access HIA is a digital subscription service that gives you access to premium content on HIA’s website. These terms govern your use of Access HIA and form a legal agreement between you and HIA.

By using Access HIA, you confirm that you’ve read and understood these terms, and that you agree to follow them.

These terms also include HIA’s E-commerce Terms of Purchase, Website Terms and Conditions, and Privacy Policy

If you don’t agree to these terms, you must not use Access HIA.

1. Access HIA Digital subscription
Important words and definitions

1.1 In these terms:

We, us, our or HIA means Housing Industry Association Limited ACN 004 631 752.

You or your refers to subscribers and users of the Access HIA Digital subscription.

Additional terms means the additional terms mentioned above and in in Section 5 that are incorporated by reference into this agreement.

Agreement means these Digital subscription terms of service.

Billing period means the standard 30 day period for monthly subscription fees.

Digital subscription the agreement for an indefinite period, for a monthly fee, between HIA and the subscriber, which gives subscriber a license to read and access premium content via the Access HIA service.

HIA’s content means all information and data in any media and form that is otherwise obtained from HIA’s website, including premium content.

HIA’s website means the website located at www.hia.com.au and any related mobile applications.

Misuse refers to the improper use or abuse of the subscription in breach of this agreement. Misuse may include an unusually high volume of premium content being accessed over a short period of time which indicates that account login details are being shared or content is being used for commercial purposes.

Premium content means articles, updates, templates, webinars and other digital content available exclusively to HIA members and subscribers.

Subscriber refers to the person entering into the Subscription in accordance with the terms of this agreement.

Subscription fee means the monthly fees payable to HIA in consideration for the right to use and access the subscription.

 

Starting a subscription

1.2 You can establish a digital subscription by going through the subscription process on HIA’s website at hia.com.au/signup/accesshia.

1.3 Your digital subscription starts immediately after HIA has received payment of the first monthly subscription fee and has confirmed the subscription via email. 

Grant of licence

1.4 In exchange for purchasing a digital subscription, HIA grants you a single user, non-transferable, non-exclusive, revocable and limited licence to access premium content.

1.5 A digital subscription may not be necessary to access some content in HIA’s resource library or on HIA’s website. However, without such a subscription your access to premium content will be limited or foreclosed.

Access to premium content

1.6 To use your digital subscription and access premium content you must have:

(a) an activated myHIA account;

(b) a device with a stable internet connection; and

(c) a modern web browser (Chrome, Safari, Firefox etc) with current updates and necessary plugins or software to view multimedia content.

Subscription period

1.7 Your digital subscription will continue indefinitely until terminated.

Content changes and modifications

1.8 Content on HIA’s website, including premium content, is regularly updated.

1.9 However, HIA:

(a) make no guarantees that any specific item of premium content will remain on the website or continue to be made available for access;

(b) may at any time change, withdraw or remove any content, including premium content from its website and

1.10 reserves the right to change, suspend, remove or disable access to any premium content, or other materials comprising part of your digital subscription at any time.

2. Your obligations
Use of content

2.1 MyHIA account: You may only access HIA’s premium content using your myHIA account login.

2.2 Non commercial, personal use only: Your digital subscription is available for your personal use only. You are not permitted to share your log-in details with another person or use your digital subscription for any commercial purpose, including to on-sell HIA’s content to any third party.

2.3 No copying or distribution: HIA’s content may not be copied, shared, modified, distributed or otherwise exploited except as expressly permitted by us.

Misuse

2.4 HIA may take steps to prevent fraud and misuse, such as restricting the amount of premium content that may be accessed at one time and monitoring your accounts for any activity that may violate these terms.

2.5 Without limiting HIA’s other rights under this agreement or at law, if we detect or suspect any fraud or misuse we may immediately suspend your digital subscription. If the matter cannot be resolved to our reasonable satisfaction, we may terminate your digital subscription, without refund.

2.6 You must contact us if you become aware that unauthorised use of your username and password has occurred.

2.7 If HIA suspects any type of fraud, HIA reserves the right to take enforcement action including the termination or suspension of your digital subscription and myHIA account.

Intellectual property

2.8 You must not engage in any activity that infringes or misappropriates HIA’s intellectual property rights, including patents, copyrights, trade marks, service marks, trade secrets, or any other proprietary right of any third party.

3. Fees and payment
Fees and price changes

3.1 Subscription fees are set by HIA and may vary from time to time.

3.2 The initial monthly subscription fee price for your digital subscription will be provided to you at the time you subscribe.

3.3 HIA will notify you at least thirty (30) days in advance of any changes to monthly subscription fee price.

Billing period

3.4 Subscription fees are billed and invoiced monthly. Payment is required to be made in advance.

3.5 If any payment date falls on a weekend or public holiday, the payments may be processed on the next business day.

Payment method

3.6 You can only pay your subscription fees by an authorised credit card or debt card (“Card”).

3.7 We may elect to accept or decline any Card for any reason, in our sole discretion.

Authorisation of automatic recurring payments

3.8 Upon activation of your digital subscription, you authorise HIA to automatically initiate monthly charges/debits from your nominated authorised Card in accordance with this agreement. You are responsible for updating your payment details, including any change in card expiration date, or security code (if applicable).

3.9 The amount charged in any given billing period may vary for reasons that may include price changes as advised to you and extra fees and charges you may become liable to pay. You authorise HIA to charge your nominated Card for any such varying amount in each billing period.

3.10 By providing this authority to HIA, you represent, warrant and confirm that:

(a) you are over 18 years of age;

(b) you are an authorised user holder of the Card and the Card is issued in your name;

(c) you are authorised to make and authorise payments using the Card; and

(d) there are sufficient funds and/or sufficient credit available on the Card account at the time each payment is processed to fund the payment in full,

(e) you will not dispute any scheduled transactions with your Card issuer; so long as the transactions correspond to these terms; and

(f) your Card authorisation will remain in effect until you cancel your digital subscription in accordance with the terms of this agreement.

Nonpayment

3.11 If we do not receive payment from you, you authorise us to continue attempting to charge your nominated Card until such time as payment is received. We may also, at our discretion, attempt to contact you to obtain updated payment information. You remain responsible for any uncollected amounts.

3.12 If your payment is unsuccessful because of insufficient funds, expiration, or for any other reason, HIA may charge you an administration fees and you remain responsible for charges that have not been paid.

3.13 We reserve the right to suspend, disable, cancel or terminate your access to the digital subscription for non-payment.

No refunds

3.14 Unless expressly provided for in this agreement, payments are non-refundable, and there are no refunds or credits for partially used billing periods. However, HIA reserves the right to issue refunds or credits at its sole discretion.

4. Cancellations and suspensions
Ending or cancelling your digital subscription

4.1 You may cancel your digital subscription at any time by contacting HIA by phone on 1300 650 620 or by emailing membership@hia.com.au

Suspension or termination by HIA

4.2 HIA may immediately suspend or terminate your digital subscription if:

(g) you fail to pay the subscription fee or we are unable to collect payment of this fee from you;

(h) acting reasonably, we suspect misuse of your digital subscription or that you are in violation or breach any of your obligation under section 3 of this agreement;

(i) you have otherwise breached this agreement, and you fail to rectify the breach within 14 days of written notice from HIA requiring the breach to be rectified or if the breach is incapable of being rectified; or otherwise.

4.3 HIA also reserves the right to suspend or cancel your digital subscription at any time in its absolute discretion for any reason. If HIA cancels your digital subscription under this section, you will receive a pro-rata refund for any pre-paid subscription fees for the unused part of your then current billing period.

5. Miscellaneous terms
Changes to this agreement

5.1 From time to time, HIA may amend the terms of this agreement by posting the amended terms on our website. The amended terms will apply for the next billing period after we have published them on the website. It is your responsibility to periodically review these terms to stay informed of any changes.

5.2 If you don’t agree with any changes, you may cancel your account as explained in Section 4.

Additional terms

5.3 As mentioned above, your digital subscription is also governed by other important terms and policies, which form part of this agreement. These include HIA’s E-commerce Terms of Purchase, Website Terms and Conditions, and Privacy Policy.

5.4 The following provisions, drawn from HIA’s E-commerce Terms of Purchase (without limitation), are expressly incorporated into this agreement:

  • Your requirement to register a MyHIA account
  • HIA Products are provided for general informational purposes only
  • HIA does not provide professional advice
  • You are responsible for seeking your own independent advice
  • HIA’s liability is limited, as outlined in those terms
  • Your rights under the Australian Consumer Law – Consumer Guarantees remain unaffected

5.5 In the event of any inconsistency between these Access HIA Terms of Service and the documents referenced above, these terms will prevail.

5.6 HIA may update any of the additional terms from time to time by publishing the changes on its website. Certain updates, such as those made to comply with legal requirements or to clarify existing provisions without altering their substance, may take effect immediately. If you do not agree to any updated terms, you may cancel your digital subscription as outlined in Section 4.

5.7 Except as stated here or agreed in writing between you and HIA, this agreement includes all terms related to your digital subscription and replaces any previous agreements, whether written or spoken.

Service suspensions

5.8 HIA may have to suspend access to areas of our website or some or all of our premium content to deal with technical problems or make minor technical changes, or update the digital content to reflect changes in relevant laws and regulatory requirements.

Electronic communications

5.9 We will send you information relating to your digital subscription (e.g. payment authorisations, invoices, notices) in electronic form only, for example via emails to your email address provided during your MyHIA account registration.

Use of data

5.10 HIA will be collecting your personal information and data as part of the registration and activation process for your digital subscription. You agree to our collection and usage of your personal information and you acknowledge that you have read and accepted our Privacy Policy.
